Terms & Conditions
Last updated: 6 October 2026
These Terms & Conditions apply to purchases made by consumers through this online store. They do not limit mandatory consumer rights under applicable EU or national law.
1. Seller identification
Seller: 3Toysm sp. z o.o., registered at Wolności 97, 42-244 Mstów, Poland. National Court Register: KRS 0001112098. EUID: PLKRS.0001112098. REGON: 528947245. VAT ID: [VAT ID]. Website: 3toysm.shop. Contact: [email protected], +48 34 328 41 84.
2. Scope
These terms govern use of the store and distance contracts for goods placed through guest checkout. A customer must be at least 18 years old and legally capable of entering a contract.
3. Products and descriptions
We aim to present each product accurately. Images may show packaging that changes over time. Product-specific identifiers, age guidance, instructions and safety warnings shown on the product page form part of the pre-contract information where applicable.
4. Product availability
Products are subject to availability. Stock is checked again when an order is submitted. If an item becomes unavailable, the customer will be informed and any payment for that item will be refunded.
5. Prices, VAT and taxes
Base prices are set in EUR. Consumer prices include applicable VAT where required unless clearly stated otherwise. USD, GBP and PLN displays are convenience conversions; the authoritative order amounts are recorded in EUR. Any destination-specific tax or import charge must be disclosed where applicable before the order is completed.
6. Ordering process
The customer selects goods, reviews the cart, supplies contact and delivery details, chooses available delivery and payment methods, reviews the total price and required legal information, accepts these Terms & Conditions, and selects the button indicating an obligation to pay.
7. Contract formation and confirmation
Submitting an order is a binding offer to purchase. The on-screen receipt confirms that the order was received, but does not by itself confirm dispatch. The sales contract is formed when the seller accepts the order, for example by dispatching the goods or sending an express acceptance. The customer should retain the order number and these terms.
8. Payment
Available payment methods and any relevant conditions are shown at checkout. Cash on Delivery is currently available; online Card Payment is marked as coming soon and cannot be selected.
9. Delivery and delays
Available destinations, methods, prices and estimates are shown on the Shipping & Delivery page and at checkout. Delivery dates are estimates unless expressly agreed otherwise. If delivery is delayed, the customer retains all rights available under applicable law, including setting an appropriate additional period where required.
10. Transfer of risk
For consumer sales, risk normally passes when the customer or a nominated third party physically receives the goods, subject to mandatory law and any carrier independently commissioned by the customer.
11. Right of withdrawal
EU consumers generally have 14 days to withdraw from most distance contracts without giving a reason, subject to legally applicable exceptions. The dedicated Right of Withdrawal page explains the period, procedure, return costs and model form.
12. Returns and refunds
The Returns & Refunds page distinguishes statutory withdrawal, non-conforming goods and any voluntary return arrangement. A voluntary policy never replaces statutory rights.
13. Legal guarantee and conformity
Consumers have statutory remedies when goods are defective or do not conform to the contract. Depending on applicable law, these can include repair, replacement, price reduction or contract termination/refund. These rights are separate from any voluntary commercial warranty.
14. Complaints
Complaints may be sent to [email protected] with the order number, a description of the issue and relevant evidence. Details are on the Complaints & Dispute Resolution page.
15. Liability
Nothing excludes or restricts liability where it cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, intentional misconduct, or mandatory product and consumer obligations. Other liability is determined by applicable law.
16. Intellectual property
Store design and original content belong to the seller or its licensors. Product names, trademarks and images belong to their respective rights holders. Content may not be commercially reused without permission or another lawful basis.
17. Applicable law and consumer rights
The law of the seller's country applies, without depriving a consumer of mandatory protections granted by the law of their habitual residence. Mandatory consumer rights always prevail over conflicting terms.
18. Dispute resolution / ADR
