Right of Withdrawal

1. Withdrawal period

The 14-day period generally starts on the day the consumer, or a third party nominated by the consumer other than the carrier, receives the goods. For multiple goods delivered separately under one order, the period generally starts when the last item is received.

2. How to exercise the right

Before the period expires, send a clear statement of the decision to withdraw to 3Toysm sp. z o.o., Wolności 97, 42-244 Mstów, Poland, [email protected]. No special wording is required. The model form below may be used but is not mandatory.

3. Returning goods

Send the goods to [RETURN ADDRESS] without undue delay and no later than 14 days after communicating the withdrawal. Include the order number where possible. Unless the seller agreed otherwise or failed to give the required information, the consumer bears the direct return cost for a withdrawal return.

4. Refund procedure

The seller will reimburse payments received, including the cost of the least expensive standard delivery offered, without undue delay and no later than 14 days after being informed of the withdrawal. The seller may withhold reimbursement until the goods are received or the consumer supplies evidence of return, whichever occurs first. Reimbursement uses the original payment method unless expressly agreed otherwise and should not incur a fee.

5. Handling and reduced value

The consumer is responsible only for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, where legally applicable and where the required information was provided.

6. Legally applicable exceptions

The right may not apply to categories excluded by applicable law, such as clearly personalised goods or certain sealed goods after opening where statutory health-protection or hygiene conditions are met. An exception is applied only when its legal requirements are satisfied; it does not affect rights for defective or non-conforming goods.

7. Withdrawal is not the legal guarantee

Withdrawal allows an eligible consumer to change their mind within the statutory period. Legal guarantee / conformity rights apply when goods are defective or do not match the contract and may continue after the withdrawal period. One does not replace the other.
